• PEACE OF MIND- COPYRIGHT INFRINGEMENT
  In a recent conflict between Sholay Media & Entertainment Ltd. and Vodafone Essar Pvt. Ltd. for enjoying the right of using the sound recording of the film Sholay by Vodafone Essar Pvt. Ltd in various areas such as caller tunes, ring tones, etc, the Delhi High Court adjudicated that the Vodafone Essar Pvt. Ltd can continue to use the sound recording and the same did not amount to infringement of copyright.
• THE NAME GAME-TRADEMARKS IN PHARMACEUTICAL INDUSTRY
  Pfizer, a large multinational pharmaceutical company, (“Plaintiff”) filed a case against the defendants who were marketing a cough syrup under the mark “OREX” which is very similar to plaintiff’s mark “Corex”. The Court granted an injunction restraining the defendant from marketing the same under the name OREX.
• ARBITRABILITY OF DISPUTES-SUIT FOR MORTGAGES NOT ARBITRABLE
  In a matter of Booz Allen and Hamilton Inc. V SBI Home Finance Ltd & ors, the Supreme Court, while examining the scope of sec 8 of the Arbitration and Conciliation Act, 1956, held that enforcement of a mortgage by sale shall be tried by court and not by an arbitral tribunal.
